1. Who we are and acceptance
These Terms of Service (the "Terms") govern access to and use of the Xurfin platform, available at xurfin.com and app.xurfin.com (the "Service"), operated by Xurfin (the "Provider", "we", "us"). By creating an account or using the Service, the person or company that signs up (the "Customer", "you") confirms that it has read and accepts these Terms. If you act on behalf of a company, you represent that you have authority to bind it.
2. The Service
Xurfin is customer relationship management (CRM) software offered as a subscription (SaaS). Depending on the plan and add-ons purchased, it includes a sales pipeline, quotes, billing and subscriptions, contracts with simple electronic signature, AI-assisted features (the "agent"), internal chat and reporting.
- AI-assisted features produce suggestions and supporting information. You are responsible for reviewing and approving their output before using it commercially.
- Generated documents (quotes, contracts, pre-invoices) use data you enter; you are responsible for their accuracy and legal validity.
- The Service is intended for business use. It is not directed to consumers or to children under 13.
3. Account, seats and security
- Each registered company gets its own isolated workspace. The first user is the account administrator and manages team access.
- The base plan includes up to 5 active seats. Additional seats or add-ons are purchased separately.
- Credentials are personal. You must keep them confidential and notify us promptly of any unauthorized access.
- We may suspend accounts that compromise the security or stability of the Service, giving notice when possible.
4. Plans, pricing and billing
- Current prices are published at xurfin.com and are stated in US dollars (USD) unless otherwise indicated. Applicable taxes (such as sales tax or VAT) are added where required based on your location.
- Billing is monthly or annual depending on the plan you choose. Add-ons are billed together with the plan. Payments may be processed by a third-party payment provider acting as reseller or merchant of record, whose own terms will also apply to the payment.
- Subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time and cancellation takes effect at the end of the current paid period. New subscriptions have a 14-day money-back guarantee; after that, fees already paid are non-refundable except where required by law. See our Refund Policy.
- During the launch period the Service may be offered fully or partially free of charge; we will give at least 30 days' notice before billing starts.
- Price changes are announced with 30 days' notice and apply from the next billing period. If you don't agree, you may cancel before the new period begins.
5. Customer data and privacy
We process personal data in accordance with applicable law, including Chilean Law No. 21,719 and, where they apply, US state privacy laws such as the California Consumer Privacy Act as amended by the CPRA (CCPA).
5.1 Roles
- Account data (name, email and details of your users): the Provider acts as the controller (or "business") to provide, operate, bill and support the Service, based on performance of the contract and our legitimate interest in operating and securing the Service.
- Data you load into the CRM (contacts, deals, documents about you and your own customers): you are the controller and the Provider acts as your processor (or "service provider" under the CCPA). We process it only to provide the Service, according to these Terms and your instructions, and never for our own purposes.
5.2 Our commitments as processor / service provider
- We process the data only to provide the Service, and everyone with access to it is bound by confidentiality.
- We do not sell or share your data or your customers' data, do not use it for targeted advertising, and do not combine it with data from other sources except as needed to provide the Service.
- We apply appropriate technical and organizational security measures: encryption in transit (TLS), per-organization isolation, role-based access control, audit logging and backups.
- We will notify you without undue delay of any security breach affecting your data, with the information you need to meet your own notification obligations.
- We will reasonably assist you in responding to requests from individuals exercising their privacy rights.
- When the Service ends, we will let you export your data and, at your request or after 60 days, delete it from production systems, unless we are legally required to keep it.
5.3 Subprocessors and international transfers
To operate the Service we use infrastructure and service providers that may process data on our behalf, some located outside Chile, including in the United States: Cloudflare (infrastructure and app delivery), DigitalOcean (database), Google (Sign in with Google, when the user chooses it), Resend (transactional email), our payment provider, and AI model providers for the agent features. These transfers are made to countries or entities that offer adequate protection, or under contractual clauses that ensure it. The current list of subprocessors is available on request at the contact below.
5.4 Individual rights
Individuals may exercise their rights to know, access, correct, delete, port, object to or restrict the processing of their personal data by writing to contacto@xurfin.com. We will respond within the timeframes required by law and will not discriminate against anyone for exercising these rights. If the person is an end customer of a Xurfin Customer, we will forward the request to that Customer and assist as needed. See also our Cookie Policy.
5.5 Data ownership
The data you load into the Service is and remains yours. You can export it in standard formats at any time from the platform or by asking support.
6. Acceptable use
- You may not use the Service for unlawful activities, to send unsolicited bulk communications in breach of applicable law (including the CAN-SPAM Act and the TCPA in the United States), to upload unlawfully obtained data, or to attempt to breach the security or isolation between organizations.
- The prospecting add-on must be used in compliance with the data protection and commercial communications laws that apply to you.
7. Intellectual property
The Xurfin software, brand, design and content belong to the Provider or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service while your account is active. The Xurfi mascot and the Xurfin name may not be used without written permission.
8. Availability, support and warranties
- We strive to keep the Service continuously available, with scheduled maintenance announced when possible.
- Support is provided through the channels published on the site, during business hours (Chile time).
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROVIDER'S TOTAL LIABILITY FOR ANY DAMAGES ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU ACTUALLY PAID IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THE PROVIDER IS NOT LIABLE FOR LOST PROFITS OR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES. Nothing in these Terms limits liability that cannot be limited by law.
10. Changes to these Terms
We may update these Terms. Material changes will be announced at least 15 days in advance by email or within the platform. Continuing to use the Service after the effective date means you accept the updated version.
11. Termination
You may end your subscription at any time; termination takes effect at the end of the period already paid. We may terminate or suspend the Service for serious breaches of these Terms, with prior notice when the nature of the breach allows. After termination, the data export and deletion rules in section 5.2 apply.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the ordinary courts of Santiago, Chile, without prejudice to any non-waivable rights you may have under the laws of your place of residence.
13. Language
These Terms are available in English and Spanish. Both versions are intended to be equivalent; if there is any inconsistency, the Spanish version prevails.
